Abstract

為促進我國職業災害權益保障制度與國際接軌,並宣誓我國落實勞動人權保護的努力與決心,提升國際地位及能見度。本研究先從法制及實務等構面,徹底瞭解台灣目前職業災害勞動權益保障制度之現狀與發展,並蒐集日本、韓國、美國、德國等主要國家的職業災害補償法制及職業災害失能勞動者重返職場機制之相關文獻及實施現況,並透過利害關係人的深度訪談及次級資料分析等研究方法,歸結出職業災害勞動權益保障制度之主要核心議題,研提整合職業災害補償法制及職業災害失能勞動者復工機制之具體建議,研究結果與建議如下:一、職業災害勞動者權益保障制度建議1.推動職業災害權益保障法制整合工程2.強化「積極行政作為」,創造友善職場目標3.整合相關執行單位權責成專責機構4.強化職業安全衛生體系建立主動臨場輔導功能二、職業災害失能勞動者重返職場機制建議1.整合職業災害失能勞動者重返職場機制2.強化雇主法定安置責任 3.鼓勵雇主僱用職災勞動者重返職場誘因 4.強制雇主僱用職業災害失能勞動者 5.鼓勵職業災害勞動者重返職場意願 6.運用AI科技建構客製化主動關懷模式
In order to promote my country's occupational disaster rights protection system to be in line with international standards, and to swear my country's efforts and determination to implement labor rights protection, to enhance its international status and visibility. This study starts from the aspects of legal system and practice to thoroughly understood the situation and development of Taiwan's current occupational accident labor rights protection system, and gathered the occupational accident compensation legal system and occupational accident disabled workers in major countries such as Japan, South Korea, the United States, and Germany. The relevant literature and implementation status of the return-to-work mechanism, and through in-depth interviews with stakeholders and secondary data analysis and other research methods, summarizes the main core issues of the occupational accident labor rights protection system, and proposes to integrate the occupational accident compensation legal system and occupational accidents. Specific suggestions on the mechanism for the resumption of work for disabled workers due to disasters, the research results and suggestions are as follows:1.Suggestions on the protection system for the rights and interests of workers with occupational accidents(1) Promote the legal system integration project for the protection of occupational disaster rights and interests.(2) Strengthen"active administrative actions" and create friendly workplace goals. (3) Integrate the powers of relevant executive units and assign special agencies. (4) Strengthen the occupational safety and health system to establish an active on-site counseling function. 2. Suggestions on the mechanism of returning to the workplace for disabled workers due to occupational accidents (1) Integrate the mechanism of returning to the workplace for disabled workers due to occupational accidents. (2) Strengthen the employer's statutory resettlement responsibility. (3) Incentives to encourage employers to hire workers with occupational accidents to return to the workplace. (4) Force employers to hire disabled workers due to occupational accidents. (5) Encourage workers with occupational accidents to return to the workplace. (6) Use AI technology to built a customized active care model.
