少年事件處理法中親職教育輔導與家庭教育法之關係研究--跨領域合作可行性

dc.description.abstract | 《少年事件處理法》是以保障少年健全之自我成長、調整其成長環境、矯治其性格為立法意旨,乃專為處理少年非行及曝險行為而立法,是為事件發生後之處理與補救,考察如何健全家庭功能、增進家人關係以防止少年非行或曝險行為的發生,正符合《家庭教育法》的立法意旨;而《少年事件處理法》第84條有親職教育輔導的規定,究竟在法院端的實施現況如何,有無困境或者尋求跨領域合作的機會,經過文獻整理後,研究者認為家庭教育是為《少年事件處理法》的護國神山,這二部法律有跨領域合作的空間,但是相關合作的文獻資料甚為缺乏,在行政輔導先行,司法後盾支應的理念架構下,值得教育界與少年司法界之關注與研究。本研究採用質性研究法,針對親職教育輔導在實務上的運作,瞭解相關的專業人員認知及作法,探求不同專業跨領域合作的可行性,最後,針對執行親職教育輔導的專業人員及行政機關提供相關的建議,期待有助於我國少年事件處理關於親職教育輔導之發展。根據本研究之結果,可歸納出以下結論:一、執行的可能性是影響法院裁定親職教育輔導的重要因素。二、與《少年事件處理法》最相關的家庭教育項目為親職教育、情緒教育。三、接受家庭教育服務的最佳時機點為任何時間、越早越好。四、關於親職教育輔導跨領域合作的法源依據為《兒童權利公約施行法》。五、運用跨院際少年事件政策協商平台會議,取得共識,作為修法合作的依據。 | zh_TW |
dc.description.abstract | The Juvenile Justice Act is based on the legislative purpose of to safeguard the sound self-development of the juveniles, to adjust their growth environment, and to rectify their character. It is specifically designed to deal with juvenile delinquency and risk-exposure behavior. It is designed to provide for the aftermath of an incident Treatment and remediation, examining how to healthy family functioning and enhancing family relationships to prevent juvenile delinquency or risky behaviors are in line with the legislative intent of the Family Education Law; and Article 84 of the Juvenile Justice Act states parenting courses, What is the current implementation status of the parenting courses provisions in the courts? Are there any difficulties or opportunities to seek interdisciplinary cooperation ? After sorting out the literature, the researcher believes that the Family Education is the sacred mountain of national protection for juvenile justice Act. There is room for interdisciplinary cooperation in the two laws, but there is a paucity of literature on related cooperation. Under the conceptual framework of administrative guidance first, judicial back-up support, it deserves the attention and research of the education and juvenile justice circles. This study adopts a qualitative research method to understand the cognition and practices of professionals regarding the practical operation of parenting courses, and explore the feasibility of interdisciplinary cooperation between different professions. Finally, it aims at the implementation of parenting courses Professionals and administrative agencies provide relevant suggestions, hoping to contribute to the development of parenting courses in juvenile justice in our country.According to the study, the conclusions are shown as follows:1.The possibility of enforcement is an important factor that affects the court's decision on parenting courses. 2. The family education projects most relevant to the juvenile justice method are parental education and emotional education. 3. The best time to receive family education services is any time, the earlier the better. 4. The legal basis for Interdisciplinary cooperation in parenting courses is the Implementation Act of the Convention on the Rights of the Child. 5. Use inter-Yuan juvenile justice policy consultation platform meetings to achieve consensus and useit as the basis for law revision cooperation. | en_US |
