我國少年矯正學校人員對非行少年之管教觀研究
摘要
本研究旨在探討少年矯正學校人員對判處感化教育處分的非行少年在校內違規行為的管教觀,在管教信念、管教態度、管教程序、管教方式等構面上的管教情形。
本研究為個案研究,主要運用訪談法,訪談對象選取迎曦中學(化名)校內教育相關體系人員與矯正相關體系人員作樣本,共選取三位輔導教師、三位教師、三位教導員、三位警衛隊隊員,總計十二位受訪人員,進行個別訪談。
本研究發現重點歸納如下:在管教信念層面,迎曦中學不同體系人員對非行少年違規行為類型與成因有高度認知共識,然而,非行少年複雜的成長背景與社會化經驗,讓校內人員對矯正成效出現兩種不同的聲音,也產生不同類型的管教信念;在管教態度層面,迎曦中學不同體系人員對非行少年違規行為的管教態度有些微差異,迎曦中學人員在管教態度上有輔導與訓導兩方管教不同調的矛盾。在管教程序層面,迎曦中學人員在對學生違規行為的簽辦程序上,符合正當法律程序規定。在管教方式層面,迎曦中學人員在面對法的規範之下,處罰方式開始多元化,也特別重視和學生用「搏感情」的方式來經營師生情誼。
最後,依據上述研究結果提出建議:少年矯正學校在政策與法令制度上應重新審思與檢討;面對管教不一致現象,應建立教訓輔管教小組分工機制,透過會議與處室協調,營造團結同心的管教氛圍;應多辦理管教輔導研習以增進同仁管教職能。
The Study on Discipline about Juvenile Correction School Personnel to Delinquents Abstract The purpose of this study is to investigate how the juvenile correction school personnel discipline and deal with the deviant behaviors of the juvenile delinquents who are subjected to educational discipline. This research mainly discusses on teacher’s disciplinary confidences, manners, procedures, and strategies. The Case Study is based on Qualitative Research, mainly using interviews. The interviewees who work in Ying Hsi High School, named for a pseudonymous way, are selected by education system personnel and correction system personnel to be samples, involving three counseling teachers, three homeroom teachers, three disciplinarians, and three school security guards, totally twelve interviewees to conduct individual interviews. The key points about results of this researchare as follows: In terms of the disciplinary confidences, all personnel have high recognition on the students who violate discipline, but the discipline confidences of the interviewees divide on the correctional effects. In terms of the disciplinary manners, there is a little difference between the personnel’s manner toward the juvenile delinquents. Counseling teachers and disciplinarians have conflict with dealing with the violators. In terms of the disciplinary procedures, the process of dealing with the juvenile delinquents who violates the discipline follows the law. And in the level of strategies in discipline, school discipline of all personnel tends to be legal under the restriction of the law and the punishment is focused on mental effort. Teachers and disciplinarians think more and apply the positive discipline approaches to convince violators and make them concede their guilt. Last, according to the conclusion mentioned above related suggestions are provided as follows: First, Juvenile Correction School policies and laws should be re-thought and revise. Second, establish discipline team division system through coordination meetings to create united and consistent discipline atmosphere. Third, reinforce the disciplining skills of present personnel by holding disciplinary studies.
